Transit country for migrants heading for Europe. Due to its strategic position, the European Union and member states are investing funds to strengthen the policy of the Libyan authorities, particularly as regards the management of migratory flows. The responsibilities of the member states with respect to the conditions of the detention centres, pull backs, evacuation procedures from the detention and resettlement centres of migrants should be investigated.

Petition to European Parliament Challenging EU’s Material Support to Libyan Abuses Against Migrants
Today, Global Legal Action Network (GLAN), and two Italian NGOs, the Association for Juridical Studies on Immigration (ASGI), and the Italian Recreational and Cultural Association (ARCI) filed a Petition to the European Parliament under Article 227 of the Treaty of the European Union, concerning the Mismanagement of EU Funds by the EU Trust Fund for Africa’s ‘Support to Integrated Border and Migration Management in Libya’s IBM Programme.

ASGI requests the immediate annulment of the Italian-Libyan Memorandum
On 2 February 2017, Fayez al Serraj for the Libyan Government of National Accord and Paolo Gentiloni for the Italian Government signed a Memorandum of Understanding, with the aim of strengthening the cooperation in the management of the Libyan borders, “in order to ensure the reduction of illegal migratory flows”.

Right to enter Italy for those who have been unlawfully pushed back to Libya
On 28 November 2019, the first instance court in Rome, in adjudicating a civil lawsuit promoted by Amnesty international and represented in court by ASGI lawyers, recognizing for the first time that a foreigner illegally pushed back by Italian authorities has the right to enter Italy to seek international protection.
